Lease Length Considerations
- Leases can be of any length as long as the duration is specific and agreed upon in writing by both landlord and tenant. Oral leases are generally limited to a term of not more than three years.
- Leases over three years must be recorded at the local county recorder’s office no more than 45 days after execution [1] .
- A general tenancy where the premises are occupied with the express or constructive consent of the landlord is considered to be month to month [2] .
